SEATTLE SOUNDERS FC 2024 COMMUNITY ASSIST OFFICIAL RULES
The Seattle Sounders FC COMMUNITY ASSIST (the “Program”) is sponsored by Seattle Soccer, LLC d/b/a Seattle Sounders FC, a Delaware limited liability company and Providence Health & Services - Washington (the “Sponsor”). No purchase necessary. A purchase will not increase your chances of winning. To enter, you must meet the eligibility requirements and participate in accordance with the rules set forth herein. The Program is void where prohibited or restricted by applicable law, and all applicable federal, state and local laws and regulations apply. The Sponsor reserves the right to cancel, modify or suspend the Program at any time.
1. THE CONTEST.
Sponsor will select a specific number of lucky nominees based on nominations received by fans or members of the community on a nominee’s behalf during each Nomination Period (as defined below) for a chance to be selected as the Program’s Honoree (“Honoree”).
2. NOMINATIONS AND ELIGIBILITY.
This Program shall begin at 12:01 AM PST on Saturday, March 2, 2024, and conclude at 7:30 PM PST on Saturday, October 19, 2024 (“Program Period”). The Program Period will consist of four (4) Program nomination periods (each a “Nomination Period”):
• Nomination Period 1: March 2, 2024 – April 11, 2024
• Nomination Period 2: April 12, 2024 – June 6, 2024
• Nomination Period 3: June 7, 2024 – July 20, 2024
• Nomination Period 4: July 21, 2024 – October 10, 2024
The number of Honorees selected during each Nomination Period is as follows:
• Nomination Period 1 = three (3) Honorees selected
• Nomination Period 2 = four (4) Honorees selected
• Nomination Period 3 = five (5) Honorees selected
• Nomination Period 4 = four (4) Honorees selected
For clarity, there will be seventeen (17) total Honorees selected during the entire Program Period. All nominations must be received
by the end of the respective Nomination Period. To apply:
(1) A nominator who is at least 18 years of age or older can nominate someone in their lives who is a “community assist” in service to others and provide all required information at https://www.soundersfc.com/terms-and-conditions/community-assist during the respective Nomination Period (“Applicant”).
(2) Only those nominations received through the website will be eligible. Only those nominees who are 18 years of age or older as of the date of nomination and who are legal residents of the State of Washington, less those who live within a seventy-five (75) mile radius around the city limits of Portland, Oregon, that extends into the State of Washington are eligible to receive any Prize.
(3) By submitting a nomination, Applicant agrees to be bound by these official rules.
Applicant expressly warrants to Sponsor that they have the authority to provide any requested information about the nominee and otherwise make the nomination under the terms provided herein. Applicant shall indemnify and hold harmless the Released Parties (as defined below) specifically with respect to this warranty and as to the veracity of all information provided in the nomination. Any Applicant who uses this Program to nominate an individual unknown to them, without their permission or to defame or denigrate any individual shall be immediately disqualified. Directors, officers, employees, contractors, agents and licenses, or their immediate families and household members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside), of Sponsor, Major League Soccer, L.L.C. (“MLS”), and Soccer United Marketing, LLC (“SUM” and collectively with Seattle Sounders FC and MLS, the “MLS Entities”) and each of their parents, affiliates, subsidiaries, and advertising and promotion agencies are not eligible.
3. DATA AND PRIVACY.
Through the nomination process, Sponsor shall request information about Applicant and nominee for the sole purpose of selecting one or more Honorees for the Program, which may include personally identifiable information. Applicants do not have to submit non-required information in order to be eligible, however, any additional fields requested provide the opportunity to provide additional details that may assist the selection committee. However, not entering those details does not disqualify the nominee. You may be asked to opt in to receive emails, and choosing not to will not disqualify your entry or impact your chance of being selected. To the extent that we ask for non-personal information about the Applicant or nominee that is qualitative or which cannot be used to identify an individual person, Sponsor reserves the right to aggregate that information and use it to evaluate the Program, report on the Program, provide feedback about the Program, and promote the Program. The email address and phone number supplied by the Applicant should be that of the Applicant. 4. PERSONALITY RIGHTS.
Upon applying Applicant grants to Sponsor the right to use nominee’s name, likeness, photograph, image or video in promotional content about the Program to be featured on Sponsors’ websites, if the Applicant and Applicant’s nominee are selected as a Honoree. Applicant warrants that they have permission to provide this right and further, on behalf of nominee and their heirs, and assigns hereby grants to Sponsor, their agents and others working on their behalf the right to use the nominee’s name, likeness, voice, and any additional audio, video or photographs taken by the Sponsor or their affiliates or representatives during the Program for advertising and marketing purposes, including on the Program website, without additional compensation except where prohibited by law (“Personality Rights”). Honoree must execute a winner declaration and release of personality rights upon selection notification. Failure to sign and return the winner declaration and release of personality rights will result in forfeit of all Honoree prizes and benefits as detailed in these Official Rules.
5. CRITERIA AND JUDGING.
All nominations which are received during the Program Period and that are otherwise deemed eligible will be judged by a selection committee convened by Sponsor at its sole and exclusive discretion. Selection committee will select amongst all eligible nominations. For each Nomination Period, a panel of at least three (3) members comprised by Sponsor at its sole and exclusive discretion shall select one (1) Honoree for each home Sounders FC match from amongst all eligible nominations received during the respective Nomination Period based on the following criteria: (i) overall nomination in reflection of the theme “Community Assist”; (ii) reflection of Sponsors’ commitment to its social impact pillars, including Fight Racism, Protect our Planet, Stand for LGBTQ+ Equality, Defend the Right to Play, and Positive Impact to Mental and Physical Wellness; (iii) unique or exemplary details.
6. SELECTED HONOREE/PRIZE CLAIM.
From each Nomination Period, there will be one (1) nominee selected per Sounders FC home match. If selected, an Applicant will be contacted via the email and/or phone number provided at the time of nomination and receive notification of the selection. The Honoree will receive, at minimum, the following (each a Prize):
(1) Four (4) Club-Level tickets to the 2024 Sounders FC match where Honoree will be recognized during a pre-match, in- stadium celebration on SounderVision;
(2) Recognition on Sounders FC and Providence-Swedish social and digital channels;
(3) Special commemorative gift; and
(4) Invitation for four (4) visitors during an exclusive team-training with other Program Honorees.
All Prizes will be designated based on match and training schedule availability as decided by Sponsor. Match date and time are subject to change. The approximate retail value of prize is four hundred US dollars ($400.00). Honoree is responsible for all taxes and fees associated with receipt of the value of the tickets and all other costs associated with attending the match. Sponsor is not responsible if the selected nominee is unable to attend the selected match, and is under no obligation to substitute the date of the match.
Sponsor is not responsible for any printing errors in these Official Rules, in the nomination questions or otherwise in any materials available at the Program website. Sponsor shall not be responsible for lost, late, misidentified or misdirected nominations, or telecommunication or computer hardware or software performance, errors, delays or failures. Sponsor reserves the right to disqualify any individual who tampers with the nomination process or the administration of the Program.
7. INDENTIFICATION.
Each Applicant on behalf of themselves and nominee hereby releases, and agrees to defend, indemnify and hold harmless Sponsor, Major League Soccer, L.L.C. and Soccer United Marketing, LLC, those working on their behalf, and each of their respective officers, members, managers, directors, representatives, employees, agents, successors and assigns (collectively “Released Parties”), from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to participation in this Program or the selection acceptance, use or misuse of the exclusive opportunity or tickets or Prize or any other substitute thereof. Any and all disputes, claims, and causes of action arising out of or in connection with this Program shall be resolved individually, without resort to any form of class action. This Program shall be governed by, and construed in accordance with, the internal laws of the State of Washington. Any action or litigation concerning this Program shall take place exclusively in the federal or state courts sitting in King County, Washington, and each Applicant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY'ʹS FEES, INDIRECT, SPECIAL, PUNITIVE,INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT WHETHER FORESEEABLE OR NOT AND WHETHER BASED UPON NEGLIGENCE OR OTHERWISE.
8. GENERAL CONDITIONS.
Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, or garbled Submissions. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties occurring in connection with the administration of the Program, the processing of Submissions, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to Applicant’s or to any other person’s computer related to or resulting from participating in this Program or from use of the online configurator tool.
CAUTION: ANY ATTEMPT BY AN APPLICANT TO DELIBERATELY DAMAGE THE ONLINE CONFIGURATOR OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF THESE OFFICIAL RULES AND MAY ALSO BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
The Sponsor and the other MLS Entities, as applicable, reserve the right, in their sole discretion, to cancel or suspend the Program for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Program.
